Short definition

AI literacy means the skills, knowledge and understanding that allow a person to make an informed use of AI systems and to be aware of AI's opportunities, risks and possible harm. Under Article 4, providers and deployers must take measures to support the AI literacy of their staff — regardless of the risk category involved.

Article 3(56) defines the concept as a capability, not a curriculum — the benchmark is therefore not a number of training hours. Article 4 has applied to every provider and deployer since 2 February 2025. In summer 2026 the Digital Omnibus softened the norm into a best-efforts duty: a company must support the development of staff AI literacy, but is not required to guarantee any individual's specific proficiency level. The appropriate level is differentiated by Article 4's own criteria: the technical knowledge, experience, education and training of those concerned, the context in which the system is used, and the persons on whom the system is to be used. No number of hours, curriculum, exam or certificate is prescribed, and no certificate creates a presumption of conformity — the Commission's AI Literacy Q&A states this explicitly. The obligation extends beyond staff to other persons acting on the operator's behalf, including subcontractors, agents and agency workers; for such external actors this must be arranged contractually, since there is no employer's right of instruction. Breach of Article 4 alone carries no dedicated EU fine, but its absence can serve as evidence for another — fineable — breach, for instance of the human oversight duty under Article 26(2).

Why this matters for an EU SME

The essence of this duty of care: it is not that every staff member becomes an AI expert, but that the company can demonstrably, and with documentation, show it took steps to build literacy. In a regulatory review, doing nothing at all remains unlawful even under a best-efforts duty.
