Short definition

The EU declaration of conformity is the provider's written statement that a high-risk AI system meets the applicable requirements of the Regulation. It must be drawn up per system, made available to the market surveillance authority, and kept for at least ten years after the system is withdrawn from the market.

The content and format of the declaration are governed by Article 47. By drawing up the declaration, the provider assumes responsibility for compliance with the Regulation's requirements — signing it carries legal consequences, not merely an administrative gesture. Where the system is also subject to other Union harmonisation legislation that likewise requires an EU declaration of conformity, a single, unified declaration must be drawn up covering compliance with all relevant legislation — simplifying administration for AI embedded in regulated products. The declaration must be updated where the system undergoes a substantial modification, since the modification may require a new conformity assessment and therefore a new declaration.

Why this matters for an EU SME

The ten-year retention duty is often left out of internal documentation plans — it is worth deciding, at the point the declaration is drawn up, who will retain it and where for the full period.
